Special Sustainability Zone Authorization Act (No. 21 of 2025)

This act authorises and empowers the Prime Minister to enter into development agreements for the establishment of Special Sustainability Zones on real property, in order to facilitate long-term economic opportunities, create permanent employment, attract foreign and domestic investment, and generate revenue.

One of its main objectives is to promote developments that advance its sustainable island state agenda, including: water security, energy transition, food security, sustainable industry, sustainable settlements, circular economy, and social protection.

Ratification process and publication requirements (Section 7)

A Development Agreement shall be ratified by a law passed by the National Assembly if the area is within the Island of Nevis. Therefore, the Prime Minister or Premier shall publish an Order in the Gazette declaring the Area defined in the Development Agreement. This Order shall specify the boundaries and description of the area, and state the effective date of the declaration, among other particulars references.

A development Agreement may contain provisions related to approval of development, including environmental impact assessments.

Jurisdiction -Section 6 (1)(i)(i)-

The Act recognises the jurisdiction of the Eastern Caribbean Supreme Court, the Caribbean Court of Justice and the Judicial Committee of the Privy Council, where such jurisdiction is stipulated as exclusive by the Constitution.
