Waste Management Act (No. 31 of 2000)

This Act defines rules for public management and disposal of solid and hazardous waste in conformity with best environmental practices. It appoints the Central Water and Sewage Authority as the National Solid Waste Management Authority to monitor waste management, licenses, and environmental impact assessments.

Waste inventory (article 5.1)

The Authority shall prepare an inventory and characterization of the solid waste generated in the country, identifying: total tonnage of waste generated, the proportions of waste according to specific classifications of waste, and the proportion of total waste generated by different sectors. The inventory shall be reviewed at least every five years.

The Minister is tasked with developing a waste strategy. The preparation process will ensure the broadest consultation, engaging scheduled agencies and waste management policy stakeholders. To ensure this process, the Minister will submit the draft waste strategy for public review and comment through a notice in the Gazette, at least one newspaper and by on a minimum of one radio station., This notice will include details on where copies of the draft strategy can be obtained for review, the address for submitting comments, and the closing date for submissions. The receipt of comments will be in a period of at least thirty days and no longer than forty-five days. 

If any component or part of the approved strategy is intended to be varied, the Minister shall publish a notice of intention specifying the area in which the strategy is intended to be varied and the reasons. Anyone may submit written comments. In addition to any public notice, the Minister may establish a consultative process with scheduled agencies and waste policy stakeholders. 

The Minister responsible for Planning, in collaboration with the Ministers of Health and the Environment, is required to review the waste strategy and conduct a comprehensive evaluation within five years of its approval. This review aims to ensure that the strategy aligns with international and regional obligations, addresses the waste management needs, remains feasible within technical, financial, and human resources, incorporates public and stakeholder consultation where relevant, and contributes to enhancing both quality of life and environmental quality.

The waste strategy shall establish outline measures for effective training of staff involved in solid waste management and effective public education and awareness regarding solid waste management.

Environmental Impact Assessment (article 11)

An environmental impact assessment pre-evaluation is required under the Act before the establishment of any waste management facility. The planning authority is mandated to conduct a preliminary screening to assess the need for an environmental impact assessment by engagement scheduled agencies.

Alternative measures (article 16.2)

The planning authority is authorized to conduct inspections to determine whether the design, development, construction, operation or abandonment of any project or activity complies with any monitoring programme, protection plan or mitigation measure.
