Waste Management - Prohibition on unauthorised removal of waste Act (No. 18 of 2004)

The Act establishes the Saint Lucia Solid Waste Management Authority as a body corporate tasked with comprehensive measures for solid waste management. The Authority is mandated to compile and regularly update an inventory of solid waste. Public participation is emphasized in the development of the National Solid Waste Management Strategy, requiring broad consultation and a public review period. The Strategy must include measures for staff training and public education on waste management. 

Inventory and solid waste characterisation (article 5.1, 5.2 and 5.3)

The Authority is mandated to compile and maintain a comprehensive inventory and characterisation of the solid waste generated in the countries according to type, volume and sector of generation. It shall be revised and updated at least once every 5 years.

Public participation in plans, programmes and policies (article 5.4, 5.5, 7.1 and 7.2)

The Authority shall prepare a National Solid Management Strategy, which shall be published for extensive consultation, particularly with Scheduled agencies and waste management policy stakeholders. The Draft Strategy will be submitted for public review and comment by notice in the Gazette, in at least two newspapers, and on at least two radio stations and one television station. The public will be advised on the location of the copies of the Draft for review, the address for submitting comments, and the deadline for making any submission, which will be set between thirty days and forty-five days.

Prior to any amendments to the Strategy, the Authority will publish a notice of intention dealing with the areas of which the Strategy is intended to be amended, the reasons for such amendment, and inviting writing submissions from any person. Additionally, the Authority may initiate a consultative process with Scheduled agencies and stakeholders.

Awareness-raising activities (article 6.2.f)

The Strategy shall outline measures for effective training of staff involved in solid waste management and effective public education and awareness regarding solid waste management.

Environmental Impact Assessment (articles 11.1 and 12.2)

Upon receiving an application for approval of the establishment of waste management facilities, the Planning Authority will undertake a preliminary screening to determine whether an environmental impact assessment is required and the scope of such an assessment. In reviewing the environmental impact assessment report, the Planning Authority shall consult with the Scheduled Agencies. 

Remediation work (article 14)

Where an inspection reveals any deficiency in the implementation of the monitoring programme, protection plan or mitigation measure, the Planning Authority may require the applicant to restore the site to its original condition and carry out any improvement or remediation work on the site with a further order for costs to be borne by the applicant.

Legal standing (article 45)

The Planning Authority, a member of the police force, the Minister, the Authority or any other person authorised in writing by the Minister may institute proceedings in a court.
