Environmental Health (Expanded Polystyrene Ban) Regulations, 2017

The objectives are to prohibit the importation, manufacture and sale of expanded polystyrene food service products, prohibit their use or provision, and promote and encourage the use of biodegradable, recyclable and other environmentally friendly containers or packaging for food in lieu of expanded polystyrene 

Liability (article 4.2)

A person who imports, manufactures or sells expanded polystyrene food service products is liable on summary conviction to a fine or to imprisonment for twelve months or to both.

Order of court (article 8)

A court which convicts a person for failing to comply with notice, in addition to the penalty, may make an order prohibiting the continuation of the contravention for which the conviction was made.

Alternative measures (article 9)

In order to achieve the objectives of these Regulations, guidance shall be provided to promote and encourage the use of recyclable, biodegradable, and other environmentally friendly products as containers or packaging in place of expanded polystyrene products.
